IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF IMOS PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO IMOS PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

This agreement to arbitrate is intended to be broadly interpreted and applies to all claims whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.
The arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could award, except that the arbitrator may not award declaratory or injunctive relief benefiting any person other than the parties to the arbitration.
14.3 Class Action Waiver
YOU AND IMOS PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR MULTI-PLAINTIFF ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class, collective, or representative proceeding.
14.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights, misappropriation of trade secrets, or other irreparable harm. Nothing in this section shall prevent either party from seeking relief in small claims court for disputes within the jurisdictional limits of such court.
